THE GAS TANK HAS EXPANDED AND BECOME POTENTIALLY UNSUPPORTED. ALSO THE FUEL HOSE FROM THE PUMP TO THE FILTER IS FAULTY AND HAS SHRUNK, NOT ALLOWING FUEL TO FLOW TO THE ENGINE. *TR
I'M RESUBMITTING THIS COMPLAINT AS I'M UNDER THE IMPRESSION MY PREVIOUS ONE FOR THE SAME CAUSE WAS NOT FILED. ISSUE IS I NOTICED A DEFORMED/LOOSE FUEL TANK ON MY BRAND NEW, 2009 DUCATI GT 1000 MOTORCYCLE UPON DELIVERY FROM THE DEALERSHIP. THE TANK HAS EXPANDED AND IS NO LONGER SECURED BY IT'S TWO FRONT BRACKETS (TWO OF THE THREE SECURING POINTS FOR THE FUEL TANK). THE TANK MOVES/WOBBLES APPROX HALF AND INCH TO THE LEFT OR RIGHT, AND A SINGLE REAR BOLT IS KEEPING IT ON THE MOTORCYCLE. I BELIEVE THE TANK IS LIKELY TO FLY OFF IN THE EVENT OF AN ACCIDENT SO I HAVEN'T RIDDEN THE MOTORCYCLE AND INTEND TO RETURN IT TO THE DEALERSHIP UNDER "BREACH OF WARRANTY". I JUST BOUGHT A BRAND NEW DUCATI GT 1000 MOTORCYCLE FROM LEXINGTON MOTORSPORTS, KENTUCKY, WHICH WAS DELIVERED TO MY HOUSE ON 3 OCTOBER 2010 WITH A DEFORMING/LOOSENING FUEL TANK. ON 18 NOV 2010, GIRARD GIBBS LLP FILED A CLASS ACTION AGAINST DUCATI NORTH AMERICA FOR KNOWINGLY SELLING THESE DEFECTIVE FUEL TANKS AND NOT FIXING THE PROBLEM SINCE 2006. *TR
